Mediators should not just jump in and jump out of your case. Successful mediation cannot just be limited to just a few hours or day-long session. Mediation is a process and one at which we excel. We will work diligently every step of the way—from a courtesy pre-mediation call from your attorney and preparation to post-mediation follow-up. We are dedicated to the mediation process from beginning to end. All designed at helping all parties arrive at the best possible outcome to their dispute.
As a practicing family attorney and mediator, I understand of all the complexities of a family case. I understand your case, your unique issues, your attorneys, the pros and cons of court and even your judge. All of this assists us in getting your case resolved.
What we do before mediations:
Courtesy Pre-Mediation Call
Our office provides parties the opportunity for pre-mediation calls in order to discuss:
- how to craft a mediation process tailored to your individual case and litigants
- when the mediation should take place and who should attend
- how to exchange information and whether opening statements will be needed
- issues the mediator should be aware of that are not included in the written statements
- any special needs or accommodations of the parties or counsel
- Notify the Court of the mediator appointment
What we do during mediations:
Listen closely to all perspectives, quickly evaluate party dynamics and establish rapport, leaving ample time for them to focus on:
- what issues are in dispute and what might motivate each party to settle
- make observations when appropriate and assisting both sides in pros and cons of the case proceeding through litigation, overcoming impasse
- pursuing creative, collaborative solutions that are consistent with the facts of the case and geared toward preserving mutual interests and ongoing relationships
- ensuring that all parties trust the process and feel they have been heard and that all reasonable prospects for settlement have been considered
- guiding parties toward resolution
- draft agreements and court orders (temporary, partial agreements or full agreements)
- file all agreements or orders with the Court.
What we do after mediation:
As we said before, we don't just jump out of a case. In the event that all issues are not resolved during the mediation session. Sometimes all that is needed is a little time for reflection. We will follow up in an effort to keep parties engaged in the process and focused on resolution. We do this until the case settles or every conceivable option has been exhausted.
